Zuckerberg’s Response to Ad Scrutiny: A New Subscription Service

Mark Zuckerberg’s Meta has unveiled its definitive response to years of intense scrutiny over its advertising practices in the UK: a new subscription service. By allowing users to pay to remove ads from Facebook and Instagram, the company is directly addressing the core complaint from regulators that users had no real choice but to submit to data tracking.
The service presents a clear choice. For a monthly fee of £2.99 (web) or £3.99 (mobile), users can opt for an ad-free experience across their linked accounts. Alternatively, they can continue to use the platforms for free, which implicitly means consenting to the personalised ads that have been the subject of so much controversy.
This response has been deemed acceptable by the UK’s Information Commissioner’s Office (ICO). The data watchdog, which had labelled Meta’s previous terms as non-compliant with UK law, welcomed the new model. The ICO believes it provides a fair and transparent choice, finally giving users the “opt-out” from ad targeting it had long demanded.
This solution, however, has failed to satisfy regulators in the European Union. The European Commission issued a €200m fine against Meta, finding that a similar subscription offering breached the Digital Markets Act. The EU’s position is that this model unfairly commercialises the right to privacy, a stance that is fundamentally at odds with the UK’s.
Zuckerberg’s new strategy, therefore, highlights a key geopolitical reality: what works as a regulatory solution in the UK is a legal violation in the EU. This divergence, described by experts as a result of the UK’s “pro-business” agenda, allows Meta to pursue a commercial solution to its legal problems in Britain, a path that is firmly blocked on the continent.
